The maximum fine for any violation of the Jeanne Clery Act has increased from $27,500 to $35,000.

The increase posted by the U.S. Department of Education in the Federal Register. The new fines were adjusted for inflation and only apply to violations that occur on Oct. 2 or later. Cases that are currently under investigation will be subject to the $27,500 rate.

“Consistent with recent rulings from U.S. Secretary of Education Arne Duncan, this means that individual misrepresentations of homicides, sex offenses, and robbery are now subject to $35,000 per violation fines” claims S. Daniel Carter, director of the 32 National Campus Safety Index. “Misrepresentations of lesser offenses may be subject to this fine given sufficient justification. Similarly, other individual violations, such as a failure to issue a timely warning, will, depending upon their severity, be subject to the new maximum fine as well."
